10 Questions to Ask Before Paying for Land

These questions can reveal fraud, hidden problems, and risks before you commit any money.

1. What is the land tenure type? Mailo, Freehold, Leasehold, or Customary — each has different rights. 2. Can I see the Certificate of Title? If the seller hesitates, that is a red flag. 3. Is the title in your name? If not, who is the registered owner and why are they not present? 4. Has the title been verified at the Ministry of Lands? Ask for the search result or do it yourself. 5. Are there any tenants or occupants on the land? Especially for Mailo land. 6. Are there any caveats, mortgages, or legal disputes on this land? A search reveals these. 7. When were the boundaries last surveyed? Ask to see the survey report or hire your own surveyor. 8. Who is the selling agent? Is the agent registered with the NLC? Ask for their registration number. 9. Why are you selling? The reason reveals urgency, and urgency can reveal pressure — or fraud. 10. Will you allow me to take 2–3 weeks to verify before paying? A legitimate seller always says yes.
